Засгийн газрын өчигдөрийн хуралдааны дараа ХЗДХ-ийн сайд О.Алтангэрэл  “Монгол Улсын Засгийн газраас стратегийн ач холбогдол бүхий ашигт малтмалын орд гэж УИХ-аас тогтоосон Ухаахудагийн ордыг хувийн хэвшилд эзэмшүүлсэн хууль бус шийдвэрийг хуульд нийцүүлэх нь зүйтэй гэв.

Үүнийг шийдвэрлэх эрх хэмжээ нь гагцхүү УИХ-д байгаа учир УИХ-ын тогтоол гаргаж, уг тогтоолоор олгогдсон эрх хэмжээний дагуу Монгол Улсын Засгийн газар “Энержи ресурс” ХХК-тай хэлэлцээ хийж, төрийн эзэмшлийн хувь хэмжээг тогтоох нь зүйтэй гэж үзэж тогтоолын төсөл боловсруулсан” гэв.
