Иргэний эмзэг мэдээлэл бүхий гэрэл зургийг цахим орчинд байршуулсан үйлдлийг шалгаж байна.

Энэ оны 01 дүгээр сарын 13-ны өдөр иргэнээс ирүүлсэн “Салсан найз залуу миний нүцгэн зургуудыг цахим орчинд байршуулж, нэр хүндэд халдсан” гэх гомдол мэдээллийн дагуу цагдаагийн байгууллагаас Хүний хувийн, эмзэг мэдээллийг цахим сүлжээнд байршуулсан иргэн Б-ийн үйлдлийг шалгаж байна.

Дууны, дүрсний, дуу-дүрсний бичлэгийг мэдээллийн эзний зөвшөөрөлгүйгээр бусдад үзүүлсэн үйлдэлд Зөрчлийн тухай хуулийн 6.22 дугаар зүйлд заасны дагуу хүнийг 500 нэгжтэй тэнцэх хэмжээний төгрөгөөр торгох хуулийн зохицуулалттай байдаг.

Харин хүний эрх, хууль ёсны ашиг сонирхолд нь хохирол учруулж болохуйц баримт, мэдээлэл тараахаар сүрдүүлсэн бол Эрүүгийн хуулийн 13.5 дугаар зүйлд зааснаар эрүүгийн хариуцлага оногдуулдаг.

“Хүний хувийн мэдээлэл хамгаалах тухай хууль”-д “Хүний эмзэг мэдээлэл” гэж хүний үндэс, угсаа, шашин шүтлэг, итгэл үнэмшил, эрүүл мэнд, захидал харилцаа, генетик болон биометрик мэдээлэл, тоон гарын үсгийн хувийн түлхүүр, ял эдэлж байгаа болон ял эдэлсэн эсэх, бэлгийн болон хүйсийн чиг баримжаа, илэрхийлэл, бэлгийн харьцааны талаарх мэдээллийг ойлгоно гэж заасан байдаг.

Иймд “Хүний эмзэг мэдээллийг задруулсан” үйлдэл нь эрүүгийн хариуцлага хүлээлгэхээргүй бол Зөрчлийн тухай хуулийн 6.27 дугаар зүйлд зааснаар хүнийг хоёр мянган нэгжтэй тэнцэх хэмжээний төгрөгөөр, хуулийн этгээдийг хорин мянган нэгжтэй тэнцэх хэмжээний төгрөгөөр торгох хуулийн зохицуулалттай байдаг тул иргэд та бүхэн хүний хувийн болон эмзэг мэдээллийг бусдад тараах хууль бус үйлдлээс татгалзаж, бусдын эрх, эрх чөлөөнд халдахгүй байх, хууль дүрмээ сахин биелүүлэхийг зөвлөж байна.

Цагдаагийн байгууллагаас 2022-2025 оны хугацаанд “Хүний эмзэг мэдээллийг задруулсан”нийт 31 хэрэг бүртгэгдэж, 18 хүнд нийт 33 сая төгрөгийн торгох шийтгэл оногдуулж, шийдвэрлэсэн байна.
