Нийслэлийн Прокурорын газраас Эрүүгийн хуулийн тусгай ангийн 19.16 дугаар зүйлийн 1 дэх хэсэгт зааснаар яллагдагч Д.Бауыржан, О.Нурлан, К.Хуаныш, А.Серикболат, А.Камелият, К.Бекжан, Т.Аршагүл, Ө.Хуралай, А.Гылымхан, К.Болат, С.Арман, Д.Есболат, Д.Ербол, С.Хонаев нарт холбогдуулан яллах дүгнэлт үйлдэж ирүүлсэн эрүүгийн хэргийг Чингэлтэй дүүргийн Эрүүгийн хэргийн анхан шатны шүүх хүлээн авч,
Эрүүгийн хэрэг хянан шийдвэрлэх тухай хуулийн 33.1 дүгээр зүйлийн 6 дахь хэсэгт зааснаар яллагдагч, тэдгээрийн өмгөөлөгч нарын хүсэлтээр шүүхийн урьдчилсан хэлэлцүүлгийн хуралдааныг 2023 оны 11 дүгээр сарын 27-ны өдөр товлосон.
Шүүхийн урьдчилсан хэлэлцүүлгийн хуралдаанаар яллагдагч, тэдгээрийн өмгөөлөгч нарын гаргасан хүсэлтийг хүлээн авч, Эрүүгийн хэрэг хянан шийдвэрлэх тухай хуулийн 33.3 дугаар зүйлийн 1 дэх хэсгийн 1.2 дахь заалтад заасан “..шүүх хуралдаанаар нөхөн гүйцэтгэх боломжгүй мөрдөн шалгах ажиллагааг хийлгэх…” гэх үндэслэлээр хэргийг прокурорт буцааж шийдвэрлэлээ.
